Terms and Conditions
User obligation
Use of this Web Site constitutes your acknowledgement and acceptance of these terms and conditions.
By using this Web Site you agree to be bound by these terms and conditions which form a binding contract between you and M B Interiors.
M B Interiors reserves the right to change these Terms and Conditions at any time by posting changes online and it is your responsibility to refer to and comply with these terms on accessing the site.
Your continued use of this site after changes are posted constitutes your acceptance of these terms and conditions as modified.
Standard Conditions of Trading
All sales shall be deemed to be made between the buyer and M B Interiors in accordance with the Terms and Conditions of Sale herein after mentioned. In the event of any conflict between the Conditions and any terms and conditions put forward by the Buyer, these conditions shall prevail.
No person has authority to make any representation on behalf of M B Interiors, which is not made or confirmed in writing and the Buyer shall not rely upon any representation unless made or confirmed in writing.
The prices for all materials or goods supplied and transportation shall be strictly in accordance with those prices at the time of order currently notified and published by M B Interiors unless otherwise confirmed in writing by M B Interiors. Goods are not sold (or tested) as conforming to any British Standard Specification or as fit for any particular purpose, unless expressly so stated in writing, and any term, condition or warranty that the goods are so fit is excluded.

Online Shopping Terms & Conditions
Definitions
"Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
"Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
"Goods" means the articles that the Buyer agrees to buy from the Seller;
"Seller" means M B Interior Eden House, Lancaster St, Carlisle, Cumbria CA1 1TF
"Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the seller.
Conditions
Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
Ordering
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller.
The Seller may choose not to accept an order for any reason.
Special Orders
Special orders cannot be cancelled once ordered from the manufacturer.
Back Orders
Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 7 days.
Prices
The Price of the Goods shall be that stipulated on the Seller's Website. The Price does not include VAT and delivery charges.
The total purchase price, including VAT and delivery charges, will be displayed in the Buyer's shopping cart prior to confirming the order. All payments will be made in GBP £'s Sterling
After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.
In the case of all sales, payment of the Price excluding vat and delivery charges must be made in full through a secure payment system.
We reserve the right to carry out further security checks on transactions prior to money being debited from the card details supplied, this helps us protect both our customers and the company from fraudulent transactions.
Rights of Seller
The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.
The Seller reserves the right to withdraw any goods from the Website at any time.
The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
Warranty
The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyer's purpose.
Limitations of Liability
Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller's agents or employees.
Waiver
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
Payment Information
Offline Payment can be made in a number of ways. The easiest way to pay is using a credit or debit card, this can be debited immediately and enable us to arrange delivery quickly providing stock is available. You may also pay by cheque, this can take 7 working days to clear, once cleared, stock can be dispatched, or special orders can be processed. You may pay by bank transfer, online banking is normally free and takes approx 3-4 working days to clear, depending on the bank, or you can perform a CHAPS transfer that is an overnight payment, and can cost between £15-£20, again depending on the bank. M B Interiors are not liable for any charges made by banks for these services, likewise M B Interiors does not charge a percentage fee for credit or debit cards.
Online Payments can be made via PayPal or Google Checkout. All credit card numbers are encrypted in the software when the payment is made using 128 bit Java encryption. This encryption begins at the form where you are asked for your credit card details. They are only decrypted after they reach the bank computers; all that passes through the internet is a scrambled message. They are not held in clear text on any web site.
Your information is not stored on an internet active computer so your details cannot be accessed by a third party.
This system is the safest way to buy and is safer than passing your details over the phone lines and at least as safe as passing your card over a shop counter.
The company accepting the payment is M B Interiors, and that is what will appear on your statement.
VAT
17.5% VAT is included on all final prices shown in your shopping cart or verbally given when placing an order.
Delivery Information
M B Interiors offer a free delivery service on orders over £400 excluding vat to mainland UK addresses, however, a surcharge may apply to some remoter Northern Scotland, Northern Ireland and Wales addresses. All orders under the £400 threshold will incur an incremental delivery charge, between £5 and £30 excluding vat, based on value of order.
Deliveries are made to the 'kerb side'. Unfortunately due to insurance guidelines it is not the driver's responsibility to take goods into your home, therefore please arrange for adequate help at time of delivery. Carpets require at least 2 people at the property to assist with unloading. Flooring deliveries could be made on a lorry or a van. It is assumed that the delivery address will be accessible. If there is likely to be a problem, e.g. the road or area is subject to a vehicle weight or width restriction; please inform us at the time of order. Deliveries are made from 8.00 am to around 6.00pm.
Estimated Times of Delivery
Requests for an E.T.A on the day of delivery are strictly at the courier's discretion. We cannot make a courier contact you to advise delivery times, we can only request this. If a courier arrives at your address and is unable to deliver on the arranged delivery date because you are not there, or there is inadequate help available, you will be liable for any additional costs incurred. ALL deliveries must be signed for.
Approximate delivery times will be advised at the time of order whenever possible. M B Interiors cannot be held responsible for delivery time schedules arranged with outside couriers, e.g. special order products dispatched direct from manufacturers.
Damaged or Missing goods
Please inspect all goods immediately on delivery, this means opening tubes to check trims, glancing over (but not opening) packs of flooring for visible damage. If you are unfortunate enough to receive a damaged or missing item, make sure it's noted on the courier's paperwork. Any damaged goods must be returned to the driver for return to M B Interiors. Replacement goods or refunds will be issued within 7 days (Subject to product availability). We cannot accept liability for damages or errors if goods have been fitted.
No claims for damaged or missing items can be made after the courier has left the delivery address, unless signed for as damaged or missing. M B Interiors do our utmost to avoid any damage by choosing the best couriers available, however some goods are sent direct from the manufacturer, which means we have no jurisdiction over the method of delivery. All claims must be made within 7 days of receipt of goods. Goods refused on delivery that are found to be undamaged on return to us will incur the return delivery charge where applicable.
No liability can be accepted for costs caused by late deliveries or for any other reason. Therefore we advise against booking installers until goods have been received.
Risk in Ownership of the Goods
Risk in the Goods shall pass to the Buyer on delivery.
Guarantee
All products are subject to a manufacturer's guarantee of at least 12 months, subject to conditions which are available upon request.
Faulty Goods
In the unlikely event that received goods are faulty, please contact our customer services manager (orders@online-floors.co.uk) to arrange a collection. A refund or replacement will then be issued within 7 working days (subject to product availability). We cannot accept liability for damages or errors if goods have been fitted but can arrange for an in-situ inspection by the manufacturers representative at a one off charge of £75.
Returns and Cancellation Policy
In compliance with EU regulations for Online Selling M B Interiors will accept whole orders (except special orders) back unopened in the Original Packaging for whatever reason within 7 days of receipt. You will need to return the goods back to us via your chosen courier within 14 days, please note your delivery cost will need to be covered by you and may be subsequently refunded. M B Interiors do not accept part order returns.
Any requests to cancel/return an order must be made either in writing to M B Interior Eden House, Lancaster St, Carlisle, Cumbria CA1 1TF or emailed to orders@online-floors.co.uk however for any whole orders returned after the 7 days a 15% restocking charge will then become applicable and this will be deducted from the refund.
All credits will be processed within 28 days. Please note that M B Interiors can only refund delivery costs if the return is a result of M B Interiors error. If you decide to cancel your order before delivery for whatever reason, except special orders, a £30 administration charge applies. If an order has been dispatched further charges may apply. In the case of a verbal order M B Interiors will always read back your order at the time, and your agreement will form a contract. M B Interiors are unable to cancel or refund any monies paid on special order items after they have been ordered.
Check that the flooring is flawless before laying them. M B Interiors will not accept any claims for damaged, faulty or wrongly described items once the flooring has been installed. Where the buyer has used or installed the goods such use or installation shall be taken as conclusive evidence that the buyer has accepted that the goods are in perfect condition. You must accept full responsibility for the suitability of the goods ordered for the purpose to which they are put. Returns must be arranged beforehand by calling 01228 546418 or to email orders@online-floors.co.uk.
This does not affect your statutory rights as a consumer.
Installation
In installing or using any goods or equipment supplied by M B Interiors the purchaser shall observe all instructions, directions and warnings issued by M B Interiors or the manufacturer.
Force Majeure
All cases of force majeure such as wars, riots, strikes, lockouts, bankruptcy, fire, water damage, delay in transport, lack of means of transport, breakdown in factories or those of our suppliers or any other unforeseeable events give us the right to postpone the fulfillment of the contract, as well as to cancel it partially or wholly without thereby conferring on the Buyer the right to claim damages against M B Interiors or the manufacturers.
Copyright and Other Intellectual Property
Unless otherwise indicated, this Web Site and its contents are the property of M B Interior, whose registered office is situated at Eden House, Lancaster St, Carlisle, Cumbria CA1 1TF. The trademarks appearing on this Web Site are protected by the laws of England and international trademark laws. Reproduction of material on this Web Site is prohibited unless express permission is given by M B Interiors.

Law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England. Any cause of action you may have with respect to your use of this site must be commenced within one (1) year after the claim or cause of action arises.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.

Although M B Interiors endeavor to display correct pricing and description at all times, M B Interiors reserve the right to refuse the sale of mispriced products. Before purchasing from us, we recommend viewing the product in person, either in a local shop or via a sample, as M B Interiors cannot guarantee the colour/pattern matching from monitor to monitor. If you need to reach us, please email us on orders@online-floors.co.uk, please note that due to the increasing amount of viruses that are unknowingly sent by computers, your email may not be received through our secure email gateway.
